1. About these Terms

These Terms & Conditions govern your access to and use of yourCare Organiser, including its free features, paid features, subscriptions, family and sponsored access, digital tools and related services.

By creating an account, purchasing a subscription or using the service, you agree to these Terms. If you do not agree to them, you should not use the service.

Mandatory rights that apply to you under consumer, digital services, privacy or other applicable law are not excluded or reduced by these Terms.

2. About yourCare Organiser

yourCare Organiser is a digital care-organisation and support service designed to help users organise information such as tasks, appointments, medications, readings, care plans, notes, briefs, care-circle information and related personal care information.

Depending on the features available to you, the service may also provide family-sharing tools, AI-assisted drafting and organisational features, reminders, support-planning tools and information relating to independent in-person support services.

Feature availability may vary according to account type, subscription plan, location, platform, technical availability and applicable law.

3. Not medical advice, diagnosis or emergency care

yourCare Organiser is not a healthcare provider, emergency service, medical device, diagnostic service or substitute for professional medical advice, diagnosis, treatment or clinical monitoring.

Information entered, stored, displayed, organised or generated through the service is intended for organisational and supportive purposes only.

Do not rely on yourCare Organiser as the sole basis for medication decisions, diagnosis, clinical decisions, urgent intervention or emergency response.

In an emergency or where urgent medical assistance is required, contact the appropriate local emergency service or qualified healthcare professional.

4. Eligibility and accounts

You are responsible for providing accurate account information and for maintaining the confidentiality and security of your login credentials.

You must not access another person's account without authorisation, impersonate another person, attempt to bypass security controls or interfere with another user's access.

You are responsible for activity carried out through your account unless applicable law provides otherwise.

5. Your information

You remain responsible for information that you enter, upload, record, store or deliberately share through yourCare Organiser.

You should only enter, upload, store or share information that you are legally permitted to use and disclose.

Where you enter information concerning another person, you are responsible for ensuring that you have an appropriate lawful basis, authority or permission to do so where required.

6. Privacy, consent and sharing

yourCare Organiser is designed so that information is not shared automatically unless a feature expressly requires this and the relevant user has authorised or initiated the sharing.

Where the service allows information to be shared with family members, carers, organisations or other recipients, you are responsible for selecting the intended recipient and reviewing the information before sharing it.

Sharing permissions may be limited or revoked where the relevant feature permits this.

Privacy controls within the application do not replace any separate Privacy Policy, privacy notice or data-protection information applicable to the service.

7. AI-assisted features

Some features may use artificial intelligence, automated systems or deterministic processing to assist with drafting, organisation, summaries, reminders or similar supportive tasks.

AI-generated or automatically generated material may contain mistakes, omissions, incomplete information or inappropriate suggestions.

You must review generated material before relying on, saving, sharing or acting on it.

AI-generated content must not be relied upon as medical, diagnostic, clinical, legal, financial or emergency advice.

Where the application presents generated content as an editable draft, responsibility for approving, modifying, saving or sharing that draft remains with the user.

8. Free and paid plans

yourCare Organiser may provide a free plan and one or more paid subscription plans, including Individual Premium and Family Premium.

Sponsored access may also be granted by an eligible organisation, employer, charity, healthcare organisation or other approved sponsor.

Features, usage limits and availability may differ between plans. The features included with a plan are those presented in the application or purchase interface at the relevant time.

9. Subscriptions

Paid subscriptions may be offered on monthly or yearly recurring billing cycles.

Before completing a purchase, the checkout will display the relevant product, price, currency and billing interval.

Unless cancelled, a recurring subscription renews according to the billing interval displayed at checkout, subject to applicable consumer law.

A paid subscription is not required to use any functionality expressly identified as part of the free plan.

10. Prices, currencies and taxes

The price and currency displayed in the purchase interface at the time of purchase apply to that transaction, subject to any mandatory taxes, charges or adjustments disclosed during checkout.

Prices may vary by subscription product, billing interval, location, currency, platform or applicable tax requirements.

Any future change to a recurring subscription price will be handled in accordance with applicable law and the requirements of the relevant payment or subscription platform.

11. Payments

Web subscription purchases may be processed through RevenueCat Billing and its connected payment-processing infrastructure.

Payment information may therefore be processed by RevenueCat or an authorised payment-processing provider rather than being stored directly by yourCare Organiser.

By completing a paid purchase, you authorise the relevant payment service to charge the amount displayed at checkout in accordance with the selected billing interval.

A payment is not treated as successfully completed merely because a checkout page was opened. Paid access is dependent on successful purchase confirmation and entitlement recognition.

12. Renewal, management and cancellation

Recurring subscriptions renew in accordance with the billing interval and renewal terms shown during purchase unless they are cancelled before the relevant renewal takes effect.

Where subscription-management or cancellation functionality is provided by the relevant billing platform, subscriptions should be managed through that facility.

Cancellation normally prevents a future renewal. Unless applicable law, the relevant billing platform or the purchase terms provide otherwise, cancellation does not necessarily end access immediately and access may continue until the end of the paid billing period.

Uninstalling or ceasing to use an application does not by itself necessarily cancel an active recurring subscription.

13. Consumer rights, withdrawal and refunds

Nothing in these Terms limits mandatory consumer rights that apply to you under applicable law.

Consumers in Germany, the European Union and other jurisdictions may have statutory rights relating to digital services, withdrawal, contract conformity, updates, termination, price changes, remedies and refunds.

Where mandatory law grants stronger rights than these Terms, those statutory rights apply.

Refund eligibility may also depend on the payment platform, purchase channel, applicable law and the circumstances of the purchase.

14. Digital-service conformity

Where mandatory consumer law applies to the provision of yourCare Organiser as a digital service, the service will be provided subject to the statutory requirements concerning conformity, functionality, compatibility and other legally required characteristics.

Nothing in these Terms removes remedies that cannot lawfully be excluded where a digital service fails to conform to mandatory legal requirements.

15. Updates and security updates

yourCare Organiser may receive maintenance, reliability, compatibility, functional and security updates.

Where applicable law requires updates, including security updates, necessary updates will be made available for the period required by law.

You should install or permit applicable updates where reasonably required for security, compatibility or continued operation.

16. Changes to the service

We may maintain, improve, update or modify yourCare Organiser where reasonably necessary for security, legal compliance, technical compatibility, reliability, service improvement or legitimate business purposes.

Where applicable consumer law restricts material changes to an ongoing paid digital service, any such change will be made only where legally permitted and any required notice, information, termination right or other remedy will be provided.

17. Acceptable use

You must not use the service to:

  • break applicable law;
  • interfere with the security or operation of the service;
  • attempt unauthorised access to accounts, systems or data;
  • introduce malicious, destructive or harmful code;
  • misrepresent your identity or authority;
  • infringe another person's rights;
  • harass, abuse or exploit another person;
  • use the service for fraudulent, deceptive or unlawful activity; or
  • circumvent access, subscription, permission or security controls.

18. Third-party services

yourCare Organiser may rely on third-party providers for hosting, authentication, databases, subscriptions, payment processing, communications, analytics or other functionality.

Third-party services may operate under their own terms, technical requirements and privacy policies.

Where you choose to interact with a third-party service, that provider remains responsible for its own service to the extent required by applicable law.

19. In-person support

Where yourCare Organiser provides information about independent in-person support providers, those providers remain responsible for their own services.

Unless expressly stated otherwise, yourCare Organiser does not employ, clinically supervise, direct or guarantee independent third-party providers.

Availability, suitability, licensing, pricing and service terms of an independent provider should be confirmed directly before services are accepted.

20. Family and sponsored access

Family Premium functionality may allow authorised users to share or coordinate selected information with members of a care circle or family group.

Sponsored access may be provided by an employer, charity, healthcare organisation or other eligible organisation and may be subject to additional eligibility or access conditions imposed by that organisation.

Sponsored access does not transfer ownership of a user's personal account or automatically give the sponsoring organisation access to information that the user has not authorised it to receive.

21. Intellectual property

The application, software, branding, design, documentation and original service content are protected by applicable intellectual-property laws.

Your right to use the service does not transfer ownership of yourCare Organiser or its intellectual property to you.

You retain whatever rights you lawfully hold in content and information that you provide to the service.

22. Suspension and termination

Access may be restricted or suspended where reasonably necessary to maintain security, protect users, prevent misuse, comply with legal obligations or address a serious breach of these Terms.

Any suspension or termination remains subject to mandatory statutory and consumer rights.

Where technically and legally appropriate, users should retain access to available data-export or account-management mechanisms consistent with applicable law.

23. Service availability

We aim to maintain reliable access to yourCare Organiser but cannot guarantee uninterrupted availability of every feature at all times.

Temporary interruption may occur because of maintenance, security measures, third-party outages, infrastructure issues, software updates or circumstances outside reasonable control.

This clause does not limit rights or remedies that cannot lawfully be excluded.

24. Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

In particular, these Terms do not exclude liability where mandatory law does not permit such exclusion.

yourCare Organiser is an organisational support tool and must not be used as the sole basis for diagnosis, medical decisions, medication safety, emergency response or clinical monitoring.

Users remain responsible for reviewing information, drafts, reminders and sharing decisions before relying on or acting upon them.

25. Privacy and data protection

Personal-data processing is governed separately by the privacy information and data-protection notices made available for yourCare Organiser.

Privacy, consent and sharing controls within the application are product controls and do not replace legally required privacy information.

26. Changes to these Terms

These Terms may be updated where reasonably necessary to reflect changes to the service, applicable law, security requirements, technology or legitimate business operations.

Where applicable law requires notice, consent, information or another safeguard before a material change becomes effective, the required process will be followed.

27. Governing law and consumer protection

These Terms are subject to applicable German law.

If you are a consumer, this choice of law does not deprive you of mandatory consumer protections that apply under the law of your country of habitual residence where those protections cannot legally be excluded.

Any mandatory rules concerning consumer jurisdiction remain unaffected.

28. Severability

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

An invalid provision will not be interpreted in a way that removes mandatory statutory rights.

29. Contact and support

Questions about these Terms or the operation of the service may be submitted through the contact or Help Centre functionality made available by yourCare Organiser.

Additional legally required provider or contact information may be provided through the applicable Legal Notice or Impressum made available with the service.
